These Terms and Conditions ("Terms") govern the provision of accommodation services ("Services") by Kamnandi Cottages ("Owner") to the guest(s) ("Guest"). By making a booking, paying a deposit, occupying the property, or using any facilities at Kamnandi Cottages, the Guest acknowledges that they have read, understood, and agree to be bound by these Terms.
Terms & Conditions
1. Bookings and Reservations
1.1 All bookings are subject to availability and acceptance by the Owner.
1.2 A minimum stay of:

Two (2) nights applies throughout the year.

Three (3) nights applies over long weekends and public holidays.

Peak season minimum stays may apply and will be communicated at the time of booking.
1.3 A booking is confirmed only upon receipt of the required deposit and written confirmation from the Owner.
1.4 A non-refundable deposit of 50% of the total booking value is required to secure the reservation.
1.5 The balance of the accommodation fee must be paid in full prior to arrival.
1.6 The Owner reserves the right to cancel any booking where payment is not received by the due date.
2. Rates and Additional Charges
2.1 Rates are quoted in South African Rand (ZAR).
2.2 Any additional costs incurred during the Guest's stay, including damages, excessive cleaning, lost keys, or replacement of missing items, shall be payable immediately upon request.
2.3 Bank charges arising from payments or refunds shall be for the Guest's account.
3. Cancellation and Changes
3.1 Deposits are non-refundable.
3.2 Cancellation requests will be considered on a case-by-case basis.
3.3 Where possible, the Owner may offer alternative dates for rescheduling, subject to availability and seasonal rate adjustments.
3.4 No refunds will be granted for:

Early departures.

Late arrivals.
-
Weather conditions.
-
Road conditions.
-
Power outages or load shedding.
-
Water shortages caused by drought.
-
Failure to utilise the booked accommodation.
4. Check-In and Check-Out
4.1 Check-in time is from 2:00 PM.
4.2 Check-out time is by 10:00 AM.
4.3 Early check-in and late check-out may be available by prior arrangement and subject to availability.
4.4 Keys will be placed in the designated key safes and access codes will be provided prior to arrival.
5. Occupancy and Visitors
5.1 The maximum number of occupants may not exceed the capacity specified for each cottage.
5.2 Only registered guests are permitted to stay overnight.
5.3 Day visitors are permitted only with prior approval from the Owner.
5.4 Functions, parties, events, excessive noise, or large gatherings are strictly prohibited without prior written consent.
5.5 Quiet enjoyment of the property and consideration of neighbours and local residents is required at all times.
6. Guest Responsibilities
6.1 Guests agree to keep the accommodation, furnishings, appliances, and grounds in a clean and tidy condition.
6.2 Any damage, loss, breakage, or malfunction must be reported immediately.
6.3 Guests will be liable for the repair or replacement cost of any item damaged through negligence, misuse, or intentional conduct.
6.4 The main entrance gate and beach gate must remain closed at all times to prevent livestock from entering the property.
7. Water Usage
7.1 Kamnandi Cottages rely entirely on harvested rainwater.
7.2 Guests are requested to use water responsibly and conservatively.
7.3 The Owner accepts no liability for temporary interruptions to water supply caused by drought, equipment failure, power outages, or circumstances beyond reasonable control.
8. Power Supply
8.1 Guests acknowledge that load shedding and unplanned power outages are a reality in South Africa.
8.2 The Owner shall not be liable for inconvenience, interruption of services, or losses resulting from power outages.
8.3 Guests use generators, candles, rechargeable lights, and other emergency equipment at their own risk.
9. Safety, Ocean and Outdoor Activities
9.1 Guests participate in all activities at their own risk.
9.2 The Wild Coast coastline is characterised by strong currents, rip currents, rocky shorelines, cliffs, and uneven terrain.
9.3 The Owner accepts no responsibility for injuries, accidents, drowning, loss, illness, or death arising from:

Swimming.
-
Fishing.
-
Hiking.
-
Rock climbing.
-
Exploring caves.
-
Boating.
-
Wildlife encounters.
-
Any other recreational activity.
9.4 Parents and guardians remain solely responsible for supervising children at all times.
10. Security and Personal Property
10.1 While every effort is made to provide a safe environment, Guests remain responsible for their own safety and belongings.
10.2 Vehicles are parked entirely at the owner's risk.
10.3 The Owner accepts no responsibility for loss, theft, damage, or disappearance of any personal belongings, valuables, cash, vehicles, trailers, boats, or equipment.
10.4 Guests are encouraged to make use of the safes provided.
11. Pets, Stray Animals and Wildlife
11.1 Pets are not permitted unless specifically approved in writing by the Owner.
11.2 Guests may not feed stray dogs, cats, livestock, or wildlife.
11.3 Guests acknowledge that stray animals and livestock may be present in the area and accept all associated risks.
12. Smoking and Fire Safety
12.1 Smoking and vaping are strictly prohibited inside all cottages.
12.2 Smoking is permitted only in designated outdoor areas.
12.3 Fire extinguishers are provided for emergencies only.
12.4 Open fires may only be lit in designated braai facilities.
12.5 Guests are responsible for ensuring that braai fires are fully extinguished before leaving them unattended.
13. Access Roads
13.1 Guests acknowledge that access roads to Kamnandi Cottages are rural roads and may be gravel, muddy, uneven, steep, or damaged.
13.2 Travel on these roads is undertaken entirely at the Guest's own risk.
13.3 The Owner accepts no liability for vehicle damage, punctures, towing costs, delays, or accidents occurring on access roads.
14. Right of Entry
14.1 The Owner, staff, maintenance personnel, security personnel, or authorised representatives may enter the property at reasonable times for maintenance, repairs, emergencies, inspections, or operational requirements.
15. Force Majeure
15.1 The Owner shall not be liable for any failure, interruption, or delay in providing services due to events beyond reasonable control, including but not limited to:

Severe weather.
-
Flooding.
-
Fire.
-
Drought.
-
Power outages.
-
Government actions.
-
Civil unrest.
-
Road closures.
-
Labour disputes.
-
Pandemics.
-
Natural disasters.
16. Termination of Stay
16.1 The Owner reserves the right to terminate occupancy immediately and without refund where a Guest:

Breaches these Terms.

Causes damage.
-
Behaves unlawfully.
-
Creates excessive disturbance.
-
Endangers staff, neighbours, property, or other guests.
17. Indemnity
17.1 Guests enter and occupy the property entirely at their own risk.
17.2 To the fullest extent permitted by South African law, Guests indemnify and hold harmless the Owners, employees, contractors, agents, and representatives of Kamnandi Cottages against any claims, losses, damages, injuries, costs, expenses, or liabilities arising from their occupation of the property or use of any facilities.
18. Governing Law
18.1 These Terms shall be governed by the laws of the Republic of South Africa.
18.2 Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
19. Entire Agreement
19.1 These Terms constitute the entire agreement between the Owner and the Guest and supersede all previous agreements or understandings.
19.2 No amendment or variation shall be valid unless agreed to in writing by the Owner.
Acceptance
By paying a deposit, making a booking, occupying the property, or using any facilities at Kamnandi Cottages, the Guest confirms acceptance of these Terms and Conditions.
